Art. 1 – General Provisions

  1. By navigating this area, the user accesses Il Centimetro, available via the URL: www.ilcentimetro.com. Browsing and placing an order on the website imply acceptance of the Terms and Data Protection Policies adopted by the website as outlined herein.
  2. These General Terms and Conditions of Sale apply exclusively to the purchase of products made through the website in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code (Legislative Decree No. 206/05 as amended by Legislative Decree No. 21/14 and Legislative Decree No. 70/03) by:

  1. Users are required to read these General Terms and Conditions of Sale before accessing the products provided by the website, as they are considered unequivocally accepted upon purchase.
  2. Users are invited to download and print a copy of the purchase form and these General Terms and Conditions of Sale, which Il Centimetro S.r.l. reserves the right to modify unilaterally and without notice.

Art. 2 – Subject

  1. These General Terms and Conditions of Sale govern the offer, submission, and acceptance of purchase orders for products on Il Centimetro. They do not regulate the provision of services or the sale of products by third parties that may be present on the same website through links, banners, or other hypertext connections.
  2. Before submitting orders and purchasing products or services from third parties, we recommend reviewing their terms and conditions of sale.

Art. 3 – Conclusion of the Contract

  1. To conclude the purchase contract, the user must complete the electronic form and submit it following the instructions provided.
  2. The form contains a reference to the General Terms and Conditions of Sale, images of each product and its price, available payment methods, delivery methods and costs, a reference to the conditions for exercising the right of withdrawal, and the terms and timing for returning purchased products.
  3. Before concluding the contract, users will be asked to confirm that they have read the General Terms and Conditions of Sale, including information on the right of withdrawal and data processing.
  4. The contract is concluded when the seller receives the completed form from the user, after verifying the correctness of the data provided.
  5. The buyer is obligated to pay the price upon completion of the online order submission process. This occurs by clicking the “PLACE ORDER” button at the end of the guided procedure.
  6. Once the contract is concluded, the seller will process the order for fulfillment.

Art. 4 – Registered Users

  1. By completing the registration process, users agree to follow the instructions on the website and provide accurate and truthful personal data.
  2. The confirmation will, in any case, exempt Il Centimetro S.r.l. from any responsibility regarding the data provided by the user. The user undertakes to promptly notify Il Centimetro S.r.l. of any changes to the data provided at any time.
  3. If the user provides inaccurate or incomplete data, or if there are disputes regarding payments made, Il Centimetro S.r.l. reserves the right not to activate or to suspend the service until the issues are resolved.
  4. When a user requests profile activation for the first time, Il Centimetro S.r.l. will assign them a username and password. These credentials are recognized as the system for validating user access to the services and constitute the sole means of identifying the user. Actions performed through this access will be attributed to the user and will have binding effect.
  5. The user undertakes to keep their access credentials confidential and to protect them with due care and diligence, refraining from transferring them to third parties, even temporarily.

Art. 5 – Product Availability

  1. Product availability refers to the availability at the time the buyer places the order. However, it is purely indicative, as products may be sold to other users before order confirmation due to simultaneous website activity.
  2. Even after the confirmation email is sent, partial or total unavailability of products may occur. In such cases, the order will be automatically adjusted, and the unavailable product(s) will be removed. The buyer will be immediately informed via email.
  3. If the buyer requests order cancellation, thereby terminating the contract, Il Centimetro S.r.l. will refund the amount paid within 30 days from the moment Il Centimetro S.r.l. becomes aware of the buyer’s decision to terminate the contract.

Art. 7 – Payment Methods and Prices

  1. The price of the products will be as indicated on the website at the time of order placement, except in the case of obvious errors.
  2. In the event of an error, Il Centimetro S.r.l. will notify the buyer as soon as possible, allowing the confirmation of the order at the correct amount or the cancellation. In any case, Il Centimetro S.r.l. is not obligated to supply the products at the lower incorrect price.
  3. Prices include VAT. Prices may change at any time, but such changes will not affect orders for which an order confirmation has already been sent.
  4. Once the desired products have been selected, they will be added to the cart. The buyer must follow the purchase instructions, entering or verifying the information requested at each step of the process. Order details can be modified before payment.

Art. 8 – Delivery

  1. Il Centimetro S.r.l. delivers throughout Italy.
  2. Deliveries will only be made to the address provided at the time of purchase.
  3. Delivery is generally made within 24/48 hours or, if no delivery date is specified, within the estimated time selected during the delivery process and, in any case, within a maximum of ten days from the date of confirmation.
  4. If delivery is not possible, the order will be sent to a storage facility. In this case, a notice will specify the location of the order and the procedures for arranging a new delivery.
  5. If you are unable to be present at the delivery address at the agreed time, please contact us to arrange a new delivery date.
  6. If delivery is not possible for reasons not attributable to us after thirty days, we will assume you intend to terminate the contract.
  7. In such cases, all payments will be refunded, including delivery costs (except for additional costs arising from the selection of a delivery method other than the standard one offered), without undue delay and, in any case, within 30 days of contract termination. Transport costs arising from the termination may be charged to the buyer.
  8. Shipping costs are borne by the buyer and are explicitly indicated at the time of order placement.

Art. 9 – Transfer of Risk

  1. The risks related to the products will be transferred to the buyer from the moment of delivery. Ownership of the products is acquired as soon as full payment of all amounts due in relation to them, including shipping costs, has been received, or at the time of delivery, if it occurs later.

Art. 10 – Warranty and Conformity

  1. The seller is liable for any defect in the products offered on the website, including non-conformity of the items to the products ordered, in accordance with applicable Italian legislation.
  2. If the buyer has entered into the contract as a consumer, i.e., any natural person acting on the website for purposes unrelated to their entrepreneurial or professional activity, this warranty is valid provided that the defect appears within 24 months from the date of delivery of the products and that the buyer submits a formal complaint regarding the defects within a maximum of 2 months from the date the defect was discovered, via email communication.
  3. In the event of non-conformity, the buyer who has entered into the contract as a consumer is entitled to have the conformity of the products restored free of charge, through repair or replacement, or to obtain an appropriate price reduction, or to terminate the contract concerning the disputed items and the consequent refund of the price.
  4. All return costs for defective products will be borne by the seller.

Art. 11 – Right of Withdrawal

  1. In accordance with current legal provisions, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days pursuant to Article 57 of Legislative Decree 206/2005, starting from the date of receipt of the products.
  2. In the case of multiple purchases made by the buyer with a single order and delivered separately, the 14-day period begins on the date of receipt of the last product.
  3. To exercise the right of withdrawal, the user may send an email indicating the order number and the user’s name to:

  1. The buyer may also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract, or alternatively, by submitting the standard withdrawal form found in Annex I, Part B, of Legislative Decree 21/2014, which is not mandatory.
  2. The goods must be returned to: Il Centimetro S.r.l., Via Enrico Berlinguer, 15 – 63844 Grottazzolina (FM).
  3. The goods must be returned intact, in their original packaging, complete in all parts and accompanied by the attached fiscal documentation. Subject to verification of compliance with the above, the website will refund the amount of the products subject to withdrawal within a maximum of 20 days, including any shipping costs.
  4. As provided for by Article 56, paragraph 3, of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the website may suspend the refund until it has received the goods or until the buyer provides proof of having returned the goods.
  5. The right of withdrawal does not apply in cases where the services and products of Il Centimetro S.r.l. are included in the categories of Article 59 of Legislative Decree 206/2005 and, in general, to all products of the Custom categories and subcategories.
  6. The website will issue the refund using the same payment method chosen by the buyer during the purchase. In the case of payment made by bank transfer, and if the buyer intends to exercise the right of withdrawal, they must provide their bank details: IBAN, SWIFT, and BIC necessary for processing the refund.
  7. In the case of an exchange due to an incorrect purchase, the user may request a product/size exchange with only the contribution for collection/delivery of the goods, amounting to €9.50 to be paid in advance through electronic payment circuits, or by sending the purchased item to the address: Il Centimetro S.r.l., Via Enrico Berlinguer, 15 – 63844 Grottazzolina, bearing the costs of reshipping the new item, which amount to €6.00.

Art. 12 – Data Processing

  1. The buyer’s data are processed in accordance with the provisions of the legislation on personal data protection, as specified in the dedicated section containing the information pursuant to Article 13 of EU Regulation 2016/679 (Privacy Policy).

Art. 13 – Safeguard Clause

  1. In the event that one of the clauses of these General Terms and Conditions of Sale is null for any reason, this shall not in any way compromise the validity and compliance of the other provisions contained in these General Terms and Conditions of Sale.

Art. 15 – Governing Law and Jurisdiction

  1. These General Terms and Conditions of Sale are governed by Italian law and interpreted in accordance with it, without prejudice to any prevailing mandatory provisions of the country of habitual residence of the buyer. Consequently, the interpretation, execution, and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law.
  2. Any disputes inherent to and/or consequent to them shall be resolved exclusively by the Italian judicial authority. In particular, if the buyer qualifies as a Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the buyer under the applicable law.
